End User License Agreement

This agreement is concluded between Индивидуальный предприниматель Липкина Лидия Александровна (INN 524830916587, OGRNIP 326527500103167, address: 603159, Россия, г. Нижний Новгород, Волжская набережная, 8/3 - 187) (the “Rights Holder”) and the person who installs or uses the “Scanner” software (libraries for reading and generating DataMatrix codes, their command-line utilities and Python packages; the “Software”) (the “User”).

1. Conclusion of the agreement

• The agreement is a contract of adhesion (Clause 5 of Article 1286 of the Civil Code of the Russian Federation). Its text is attached to every copy of the Software (the LICENSE.txt file in the archive) and is published on the website. Starting to use the Software — installing it, running it, or linking the library to a program — constitutes the User’s acceptance of the agreement.
• If the User does not agree with the agreement, the User may not use the Software and must delete its copies.

2. Trial use

• The Rights Holder grants the User, free of charge, a simple (non-exclusive) license to use the Software for the purpose of becoming familiar with it and evaluating its capabilities for 30 days from the first run of the Software on a computer. No registration or key is required for this.
• The Software may be reproduced (installed and run), including as part of the User’s own programs to which the library is linked.
• When the trial period ends, the Software stops working until a license key is activated. Further use is possible only under a license acquired under the public offer.

3. Use under a license

The scope of rights, the number of computers and the term of a paid license are determined by the public offer (license agreement) and the order. A paid license also covers the use of the Software as part of the User’s own programs on the computers for which it was acquired. For a paid license, this agreement applies to the extent it does not contradict the offer; in the event of a discrepancy, the offer prevails.

4. Restrictions

The User may not:

• distribute the Software or its parts in a form that allows them to be used separately from the User’s programs, sell or rent them out, or grant sublicenses;
• transfer license keys to third parties;
• decompile or modify the Software, or circumvent technical protection measures, including the trial period limitation, except in cases expressly permitted by Article 1280 of the Civil Code of the Russian Federation;
• remove or alter information about the Rights Holder or the license texts attached to the Software.

5. Information transmitted by the Software

During the trial period, the Software transmits nothing over the network. On license key activation and license verification, the Software transmits to the Rights Holder the computer information needed to limit the number of computers; its composition and the processing procedure are described in the personal data processing policy. Offline activation is described in the documentation on the website.

6. Third-party software

The Software includes components of third-party rights holders distributed under their own (open source and free) licenses. The texts of these licenses are attached to the Software (the licenses/ directory in the archive); these components are governed by the terms of their licenses.

7. Liability

• During the trial period, the Software is provided free of charge “as is”. The Rights Holder is not liable for losses arising from the use of or inability to use the Software during the trial period, unless otherwise provided by law.
• Liability under a paid license is determined by the offer. The consumer rights established by Law of the Russian Federation No. 2300-1 of 7 February 1992 “On Protection of Consumer Rights” are not limited by this agreement.

8. Term

The agreement is valid from the start of use of the Software until the end of the trial period and, if a license is acquired, for the term of that license. In the event of a breach of the agreement, the right to use the Software terminates.

9. Governing law and disputes

The agreement is governed by the law of the Russian Federation. Disputes are resolved in the manner set out in the “Disputes” section of the public offer.
